MSPsites.com provides digital solutions tailored for Managed Service Providers, including website design templates, marketing tools, CRM integration, and various customization options designed to enhance your business's online presence and operational efficiency.
3. User Obligations
You are responsible for all activities conducted under your account and must use our services only for lawful purposes. You must ensure that any content you upload or information you provide is accurate and does not infringe on the intellectual property rights of others.
4. Intellectual Property Rights
All content, including text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, and computer code on MSPsites.com, is owned by us or licensed to us and is protected by copyright and trade laws. You may not use any of our content without our prior written permission.
5. Account Security
You are responsible for maintaining the confidentiality of your login information and are liable for all activities under your account. Notify us immediately of any unauthorized use of your account or other security breaches.
6. Maintenance and Technical Support
We may install software updates, bug fixes, upgrades and error corrections in the Hosted Service as we deem necessary from time to time, provided that the updates or installations are not inconsistent with the Agreement.
7. Termination and Suspension
We reserve the right to suspend or terminate your account or access to our services if you breach these Terms & Conditions, abuse our services, or engage in unlawful activities through our platform.
8. Website Update Requests
Website update requests exclude the creation of new content, it refers only for single tasks using designs that are already built within the framework. For example, if there are tasks that require multiple pages, our developers will do the first one, we'll record a tutorial video on how the page can be edited and you will have to update the copy for the rest of the pages.
9. Overage Usage Charges
Our platform operates on a credit system, aligned with our "pay-for-what-you-need" philosophy. Each account receives $10 in monthly credits for flexible use. This allocation should suffice for most early-to-mid stage MSPs. Should your needs surpass this, we offer competitive pricing, charging only for your actual monthly usage, as mentioned on our website.
10. Out of Scope Items
Items not included in our default packages are considered out of scope. These include:
Creation of special pages, such as forms that need to be hidden behind a password-protected page, or pages with a different design/layout than those in the provided templates.
Third-party integrations, except for those available on our platform.
Special design requests, such as custom website banners, specially made icons, newsletters (if included in the subscription).
Additional page copies etc.
Implementation of these items can be arranged after an evaluation of the requirements and will incur an additional fee.
10. Prohibited Use
You agree not to use the Website:
In any way that violates any applicable federal, state, local and international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the United States of America, the United Kingdom or other countries);
To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any “junk mail”, “chain letter” or “spam” or any other similar solicitation;
In a any manner that could disable, overburden, damage, or impair the site or interfere with any other party’s use of the Website, including their ability to engage in real time activities through the Website;

We may update these Terms & Conditions from time to time to reflect changes in our services, user feedback, or legal and regulatory changes. We will notify you of any significant changes through the website or through direct communication.
12. Disclaimers
MSPsites.com is provided on an "as is" basis without warranties of any kind, either express or implied. We do not guarantee that the site will operate error-free or that the site and its servers are free of computer viruses or other harmful mechanisms.
13. Limitation of Liability
In no event will MSPsites.com be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of or inability to use our services.
14. Indemnification
You agree to defend, indemnify, and hold harmless MSPsites.com, its officers, directors, employees, and agents, from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of our services or your breach of these Terms & Conditions.
15. Payment for Service
Monthly billing begins thirty days after the setup fee is paid for a client’s website. MSPSites will not begin work on the client’s website until setup payment has been received. All invoices submitted by MSPSites are payable by the client upon receipt unless other arrangements are made by MSPSites with the client, in which case specific payment amounts, schedule and terms of payment shall be provided by MSPSites to the client. Payment will be made automatically by Credit Card unless other arrangements are made by MSPSites with the client.
16. Payment Failure
Payments are made automatically by credit card at the start of each month’s service. Should automatic payment fail, the client will be notified of payment failure. MSPSItes will then attempt payment a second time three days later. Should automatic payment fail a second time, a third and final attempt will be made five days after the second failed attempt. Technical support and training services will not be provided after a second payment failure until payment is received. All services - including website and email - will be frozen after a third payment failure until payment is received. MSPSites reserves the right to discontinue service at any time.
